Alexander Calder died in 1976 so this sculpture is probably still in copyright. In the US freedom of panorama does not extend to sculptures. I suggest reuploading at a reduced resolution and using a fair use tag such as {{Non-free 3D art}} Jeremy (talk) 01:47, 12 November 2007 (UTC)

No, it's an image of a 1929 mechanical reproduction of a work first published in 1658. {{PD-old}} is entirely appropriate per Commons:Commons:When to use the PD-Art tag#Photograph of an Old Master scanned in from a recently published book: "book-publishers cannot normally claim any new copyright on their reproduction if it is a mere mechanical copy of the original".
