  • Um, it's a fair use image properly tagged as fair use, with a note that a court has ruled that the state of Ohio cannot prohibit fair use of its intellectual property. I see nothing wrong with this image, considering the fact that the subject is now dead and no new free picture could be produced. As well, mug shots may actually be pd-ineligible but the community hasn't been able to reach consensus on that. -N 16:13, 8 July 2007 (UTC)
  • It does not have a proper fair use rationale, those Ohio legal snippets contradict each other and suggest it can only be used for 'educational and non commercial use' - that isn't allowed in wikipedia, it can only be used as fair use and references to non commercial use should be removed.     • Fair use cannot be restricted by the copyright holder! That's why it's fair use! It's an EXEMPTION from copyright. And of course we aren't competing commercially with police agencies for mug shots! -N 10:12, 9 July 2007 (UTC)
but there are legitimate uses of fair use and uses that are not legitimate fair use. We can use such an image under fair use exceptions of US law without the permission of the copyright holder, but if you put legal quotes in the image as a rationale saying it can be used 'non commercially and for educational use only' that is not fair use but is permission by the copyright owner for a specific application, we do not enter in such contracts on wikipedia according to policy. Looks to me more like JPEG artifacts, not scan lines. And, it is indeed possible for a contract photographer to take a picture and release it into the public domain. 69.143.136.139 00:29, 21 July 2007 (UTC)
That is true, but evidence of creation is required. Also, the image probably is from a TV broadcast; certain artifacts are indicative of 3:2 pulldown but are pretty hard to find given the overall JPEG artifacting. A contracted photographer can't release an image by the way, as it is a work for hire. east.718 10:03, 23 July 2007 (UTC)
Actually, as a consultant I can tell you that's not the case. You're obligated to turn over the rights for works provided on-contract. However, works can be created with, e.g., a personal camera, or while on a break, things like that. It's very murky. Evidence of creation isn't required for everything. In fact, above I mentioned the quarter pounder article. In that case, the assumption is made that nobody took that image under contract. It's easy enough to make the same assumption here, given the abysmal quality of the image – or indeed to assume nobody's going to come after it. Either way, I've said my piece. The reason I left was the image nazis (or at least a large part thereof), so I've no interest in squabbling about it. I'm certainly no "image nazi"; you'll find I'm one of the most relaxed editors here when it comes to non-free use. The only reason I sent this image to PUI is exactly that—it's of very poor quality and quite obviously comes from a TV broadcast. east.718 21:08, 25 July 2007 (UTC)
