This is a hard one.... This is a picture from Tibet in 1940, at which time (according to History of Tibet) sovereignty was in dispute between China and Tibet. I don't know what if anything Tibetan copyright laws were at that time, and I don't really understand {{PD-China}}. Can anyone help sort this out? Mangostar (talk) 00:01, 17 December 2007 (UTC)
- This IS a hard one. I doubt very much that Tibet had any copyright laws in 1940. Seeing as the photo seems to be in general use in many publications without attribution - I would think it is fair to consider it as being in the "public domain". John Hill (talk) 00:43, 17 December 2007 (UTC)

- Tibet was never internationally recognized as a sovereign state. In 1940, the sovereignty of the Republic of China (Chungking for the allies, Nanking for the Axis) was internationally recognized over Tibet. The justification here will have to be that PD-China cannot be used in Wikipedia. - PD-China looks like it was recently changed to backdate the cut-off point to 1923, since there was a 1904 bilateral treaty with China. However, the same source it gives for this also says in a footnote that the PRC doesn't view this treaty as binding. Should we change the template back to the 1940s cutoff time because of this?
