Joe Mabel licenses his rights to the image under GFDL. A fair use issue arises because the sculpture is a work of art protected by copyright. Since the controversy over the sculpture is discussed at some length in Picardo Farm, it should meet fair use criteria: obviously, the only way a truly free image could be obtained would be from the sculptor himself or someone entitled to act on his behalf.
