[edit] Summary

This picture is an extract of an issue of the Magazine ST Format that featured a test of the Phaleon Demo. This picture as been online on my website (http://www.defence-force.org/computing/atari/demos/index.htm) since 1998 without any problem -the magazine stopped in September 1996-, so I doubt there would be any problem.

[edit] Fair Use for NeXT (demogroup)

Non-free / fair use media rationale for NeXT (demogroup)
Description

The image is a scan of a review, consisting of a review, a screenshot, and a comment about the screenshot. The screenshot shows an extract of the reviewed product, and the text merely comments on the image.

Source

ST Format magazine, Issue 38, September 1992

Article

NeXT (demogroup)

Portion used

It is only a cropped area of a single page of a magazine, which does not show anything not directly related to the aforementioned product. More than one third of the picture is occupied by a photo of the reviewed product, on which the NeXT demo group own the copyright.

Low resolution?

The image has been scanned to the smallest possible resolution that still allows readability. The original source being a printed material is of course of very high resolution.

Purpose of use

Show that the reviewed product was considered important enough to be reviewed by the biggest British Atari magazine, thus proving the claims about the legitimity of the demo group who made the demo.

Replaceable?

This is the only available source showing the product was reviewed in commercial publications and so it is completely irreplaceable.
