Although this image is subject to copyright, its use is covered by the United States fair use laws because:
- It's a low resolution screen shot of the video game under discussion.
- Use of the image doesn't limit the copyright owner's rights to sell the game in any way, but in fact may encourage sales.
- Because of its low resolution copies of it could not be used to make any illegal copies of the image.
- Its sole use here is to identify the subject of discussion within the article.
- The image is significant because it is used to explain aspects the game.

- The image was derived from digital capture (photo/scan) of the video game. The creator of this digital version is irrelevant as copyright in all equivalent images is still held by the same party. Copyright is held by the game's developer, Virgin Games. Claimed as fair use regardless.
