I (Matt Crypto) feel it is covered by the U.S. fair use laws because:

  1. The image is used for educational purposes only in a non-profit encyclopedia.
  2. The image is no larger and of no higher quality than is necessary for the illustration of an article.
  3. The artifact depicted is an historical cipher machine which is no longer in production or for sale.
  4. The use of the image on Wikipedia is not expected to decrease the value of the copyright.
  5. Its inclusion in the article adds significantly to the article because it shows the subject of this article.
  6. The image was likely a promotional image for the product in question.
