[edit] Controversy
In March 2008, the college's Vice-president of Student Services, Dr. Richard MacLennan, trespassed until-then returning student and math/writing tutor Kristian G. Berry from all OC campuses.Citation needed; recommended: OC's own newspaper MacLennan also involved local law enforcement and reportedly the Federal Bureau of Investigation in the case as a response to emails from Berry that he deemed threatening and disruptive of order at the college. Berry attempted to appeal the decision to the college's student conduct board but was informed by OC's president, Dr. David Mitchell, that (regardless of his status as a prospective student), Berry could not invoke the student conduct code on his behalf inasmuch as he had not been punished in the context of his student status but instead as a college employee. However, the OC website section covering staff/faculty policies only referenced the authority to prohibit trespass under the section on the student conduct code, indicating that this authority was derived from that body. In light of the legal complexities of the case, therefore, Berry has continued with his attempts to appeal to the student conduct board.
