Ötzi the Iceman, a well-preserved natural mummy of a Chalcolithic (Copper Age) man from about 3300 BC, who was found in 1991 in the Schnalstal glacier in the Ötztal Alps, near Hauslabjoch on the border between Austria and Italy. It is submitted that use of the image in the article "Ötzi the Iceman" is fair under U.S. copyright law, and the laws of other jurisdictions where applicable, for the following reasons:

  • The image is not replaceable. Ötzi is now housed at the South Tyrol Museum of Archaeology in Bolzano, Italy. For preservation reasons, it is highly unlikely that visitors to the museum will be permitted to take photographs of the body. Therefore, it is also unlikely that an image which does not rely on the doctrine of fair use is easily obtainable.
  • The image is small and of a low resolution.
  • Use of the image in the article is unlikely to impair the sale of the original, high-quality photograph.
