I, Mailer Diablo (talk), assert that the screenshot qualifies as Fair Use under the US Copyright Law on Odex's actions against file-sharing for the following reasons :

Depicts the incident in question, relevant to the topic
Inferior quality, resized to 300px
No free replacement (assuming that the hacker retains copyright)
Circulated and publicized by the local media for commentary
