Nottebohm (Liechtenstein v. Guatemala)

Nottebohm is an International Court of Justice case between Liechtenstein(Applicant) and Guatemala (Respondent).

Liechtenstein claimed reparation in forms of restitution and compensation on the basis of diplomatic protection for Friedrich Nottebohm, a Liechtenstein citizen residing in Guatemala for long years. After he has been subject to criminal jurisdiction in Guatemala, Liechtenstein has put protection claims forward.

Nottebohm, originally a German citizen, gained Liechtenstein citizenship during the first years of the World War in terms of naturalization.

The court, while recognizing the principle of diplomatic protection, denied Liechtenstein's claims stating that there shall be a link in between the national state and the national for diplomatic protection to be applied. In this case, the link was not present and therefore, Liechtenstein was deemed as not able to claim any protection over Nottebohm.

The proceedings began in 1951, and court delivered two judgments. One in 1953, preliminary objections, and the final judgment came in 6 April 1955.
