The image is not free and its copyright belongs to the government of Russia. Still I, Alex Bakharev believe that usage of the image in the articles related to the history of Soviet Union constitutes fair use as defined in the law of the United States:

  • This is an official photo of the Soviet leader showing how he and his government wanted people to see him
  • The picture were distributed as a promotion for the Soviet Union
  • For thirty years until Russia signing Bern declaration in 1990ies the image was public domain in the United States of America
  • The image is of low resolution and has no commercial value whatsoever, using it on Wikipedia does not interfere with any possible usage of the image by the Russian government
  • Image usage for the relevant historical articles improves their quality as it shows an official image of the Soviet leader, the way he was seen by the contemporaries.
  • The photo cannot be substituted by casual photographs of Khruschev as they do not show his official image
