The use of the image in the article My Fair Lady qualifies under the fair use doctrine because:

  • It is a low-resolution image;
  • Its use will not limit the copyright holder in realizing profits or other opportunities in connection with the image;
  • It cannot be replaced by an equivalent free image (it is a historic playbill cover of a famous production that closed long ago); and
  • It is a key visual reference in the article concerning its Broadway production of the musical that is the subject of the article.
