[edit] Rationale of fair use for new generation of African leaders

The image Image:MuseveniKagame.jpg is being linked here; though the image is originally copyright, I (TreveXtalk 19:51, 5 September 2005 (UTC)) feel it is covered by fair use because:

  1. The use of this image in the article is important because it depicts two of the major figures (Yoweri Museveni and Paul Kagame) that were considered to be part of the "new generation" of African leadership, which is the topic of the critical discussion in the article. The fact that the two leaders are pictured in discussion serves to illustrate the personal ties between many of the so-called "new generation".
  2. There are no free or public domain images depicting two or more members of the "new generation" together.
  3. The image was made available in the online Rwandan Presidential photo album and is therefore intended for wide distribution.
  4. The image does not limit the copyright owners' rights to distribute the image in any way.
  5. The United States Copyright Act of 1976 provides for "the fair use of a copyrighted work...for purposes such as criticism, comment, ...scholarship, or research".
