This image is the cover of a videotape, DVD, Blu-ray Disc, etc. and the copyright for it is most likely owned by either the publisher of the video or the studio which produced the video in question. It is believed that the use of low-resolution images of video covers to illustrate the videotape in question on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law. This image, Movie DVD cover pit and the pendulum.jpg, is being linked here; although the picture is subject to copyright I (Hal Raglan) feel it is covered by the U.S. fair use laws because:

• According to the Wikipedia:Fair use tag for DVD covers, "it is believed that the use of low-resolution images of DVD covers, to illustrate the movie in question, qualifies as fair use under United States copyright law." The DVD cover is a scanned .jpg file taken directly from the MGM DVD cover of The Pit and the Pendulum. The image has been added to the article to assist in critical commentary/discussion of the film in question. Also:

1. It is of much lower resolution than the original (copies made from it will be of very inferior quality).
2. It does not limit the copyright owner's rights to market or sell the work in any way.
