I tried to upload a better version of Image:Megrahi2.jpg but the image size was wrong. I therefore reverted to the previous version. The better version has now been uploaded to Image:AlMegrahi.jpg and three articles have been linked to it.

There are now no linked articles to Image:Megrahi2.jpg, so it can be IfD'd.Phase1 16:00, 18 October 2005 (UTC)

What was wrong with the first one, Phase, and what made you think it wasn't licensed properly? We were claiming fair use. You've uploaded the same photograph, but are claiming it can be used freely, so I'm confused. Can you clarify? SlimVirgin (talk) 16:14, 18 October 2005 (UTC)

I'm confused too in that case. I thought that the 'fair use' tag that had been applied to the Image:Megrahi2.jpg meant that it should be avoided unless its use could be justified in each case. I therefore uploaded the slightly different Image:AlMegrahi.jpg to overcome that perceived difficulty. I was simply following the deletion recommendation, and have no views one way or the other as to whether the Megrahi2 image should be deleted.Phase1 17:33, 18 October 2005 (UTC)
The thing is that if the image is copyrighted, it doesn't matter which website it comes from. You wrote that the copyright holder was allowing it to be used anywhere. But do we know who the copyright holder is? The image is fair use because it's a unique image (there are no freely available pics of him so far as I know); it has no commercial value (some images of him would have value, but not this one, because it's old and widely available); it's a small version of the original; and we're using it for educational purposes. Did you have a reason to think the new one you uploaded had a different copyright status?
I agree that the whole fair-use issue as described on WP is very confusing. In general, it's always better to find a free-license image, but I doubt if such a thing exists of him. SlimVirgin (talk) 17:42, 18 October 2005 (UTC)
I am grateful to you for this explanation. Since Megrahi2.jpg is a much better pic than AlMegrahi.jpg, could I ask you to revert the three image edits I made today to: Abdel Basset al-Megrahi, Pan Am Flight 103 bombing trial and Pan Am Flight 103?
