This is NOT a mugshot of McLean. An original version of this photo can be seen at [1] under the title "The end of James “Buddy” McLean, first boss of the Winter Hill gang." Since when are mughsots taken outdoors with trees in the background?

- While you are certainly entitled, and of course encouraged to point out copyright violations and infringement, in this specific instance the photo is claimed by author T.J. English to be the property of the Boston Police Department and thus constitutes as belonging to the public domain. Furthermore, I believe the photo is used in accordance to the fair use policies as defined by Wikipedia as it is a historically significant photo of a famous individual and used for informational purposes only. Also the link you have provided seems to point to the official website of broadcaster Howie Carr which does not appear to have the photo. I should also point out, at least in my view, the photo is taken indoors as both a ceiling and doorway are visible in the background. MadMax 21:00, 23 September 2006 (UTC)

- First the picture presently displayed, as compared to an admittedly similar one you present, are noticeably different not only as a much closer view but the areas on both sides are darkened. Nor do the lines above (which in my view are ceiling tiles) match those from the other picture. Even if the picture was altered in some way, nowhere in T.J. English's book is their a citation for any pictures belonging to whiteyworld.com. This particular picture is specifically stated as the property of the Boston PD and, as I've already stated in the previous message, is covered under fair use. Assuming you are affiliated with said website, I suggest you take the matter up with the author and/or HarperCollins Publishers. MadMax 07:27, 24 September 2006 (UTC)

- I have clearly stated my sources regarding the image, not only in the summery but in this conversation as well. If you wish to take it up with Wikipedia administrators by all means you are welcome to. However, repeated removal of content and disregarding even basic guidelines will only result in your IP becoming blocked from editing. MadMax 05:28, 26 September 2006 (UTC)
- I don't get it. How is this picture from Whiteyworld.com ? This might seem like a stupid question but almost all the pictures have the website logo on them. If the photo is stolen from the website, wouldn't it still have the logo on it ? 205.188.116.6 03:44, 27 September 2006 (UTC)

- I will agree that the two picture in question, especially when viewed full size, bear an uncanny similarity in pose and dress; however, the backgrounds are completely different. If you look carefully at the image on wikipedia and cited to T.J. English's book at full size: [4], you will see that Frank appears to be standing in front of a wall of some kind with a rectangle drawn behind him, wheras the whiteyworld.com photo has trees and houses in the background. Given, then, that they are NOT the same picture, I think the correct course of action regarding the picture here is to follow the citation given in the source book, and allow that it is a boston police department photo (admittedly perhaps not a mugshot, but if the author and source cites the boston PD). My appologies to users 24.34.42.90 and 71.243.121.73, who as in the past may or may not represent Mr. Carr and Whiteyworld.com, but I think if you look closely you will agree that the pictures are not, in fact, the same.
As in the past and as always, if you feel that content on wikipedia violates a copyright which you are the owner of, you may follow our internal procedures for copyvio removals, or if you prefer to use the slower formal method of a Online copyright infringement act request in accordance with US law, you may lodge such a complaint with wikipedia's Designated Agent [5]. Both of these procedures will bring your matter to wikipedia officials and legal council who will handle it. This is a copyright violation. Look at the face, eyes, it's identical. Please provide the source where this image was aquired from and name of the photographer.
