This is a piece of public art that I took the picture of and as such is considered a fair-use derivative for copyright purposes.

Fair Use for Barry McGee article includes:

  1. This is a significant artwork that could not be conveyed in words.
  2. This notable example is typical of significant artist's work.
  3. There is no alternative, public domain or free-copyrighted replacement available.
  4. Inclusion is for information, education and analysis only.
  5. Its inclusion in the article adds significantly to the article because it shows the work of the subject of the article.
  6. The image is a low resolution copy of the original work of such low quality that it would be unlikely to impact sales of the work.
  7. The original has since been destroyed.

Fair Use for Mission School article includes:

  1. This is a photograph of artwork by a graffiti artist committed to public art, which shows its relation to the exterior space in which it is placed.
  2. This photograph shows in the context of the article how McGee is in a continuum with other San Francisco artists in the above respect, such a continuum being that documented by the subject of the article, in a way that could not be adequately imparted in words.
  3. The murals represented in this photograph no longer exist.
  4. There is no alternative, public domain or free-copyrighted replacement available.
  5. Inclusion is for information, education and analysis only.
  6. The image is a low resolution copy of the original work, illustrative and indicative of it only.
