Low-res version of copyrighted picture of Matthew Shepard by Gina Van Hoof

This picture, posted on the website of the Matthew Shepard foundation found here. The foundation says on their FAQ page that permission is needed for public use of the picture. Even so, I presume that a low-res cropped version of the Van Hoof photo would be covered by fair use for use in Matthew Shepard because Shepard is deceased, a notable person of historical importance, and no other picture is available. This rationale for fair use only for the purpose of illustrating Matthew Shepard in the article about him.

I have contacted the Matthew Shepard Foundation for permission to post a picture covered under GFDL. I got a reply saying that a decision would follow, but it has been several week without a reply. I'm e-mailing them again for permission. --Samuel Wantman 23:30, 15 March 2007 (UTC)
