Obtained from discarded lies blog [1]. The image was the highest resolution copy of the image found on the web; the proprietor of this site is presumed to be the copyright holder by the person who uploaded this image. A commant by zorkmidden, the original submitter of the blog entry, claims that "the picture was taken by a Chevron employee in Venezuela."

The four factors: Transformative factor:
- The original use of the image was to document the condition of the Mars Platform after Hurricane Katrina. The use of the image at World's tallest structures is to juxtapose the height of the platform as undamaged to the height of the platform as damaged. This is clearly transformative.
Nature of work factor:
- The original purpose of the image was obviously to depict a factual situation, and has no artistic merit.
Amount and substantiality factor:
- The image was part of a larger work, and the image itself was supportive of a textual description.
Effect of use on market factor:
- The effect on the market is negligible because:
- the image is dated material;
- the image is freely available in several locations;
- the image does not depict a product or service which is for sale/is profitable.
