From Wikipedia, the free encyclopedia

Hello. Please explain why this image was released in the public domain. Thanks. --Edcolins 13:20, 8 December 2005 (UTC)

I e-mailed Mandy Haberman for details on her biography. She pointed me at the imagebank downloadable at her site[1]. I asked her if it was useable and she told me that the images at the imagebank were available for everyone as long as used unaltered and within the right context. So I figured, if it is free for download and use, it's public domain. The Haberman feeder image is from the same imagebank. Felsir 14:42, 8 December 2005 (UTC)
The page "Disclaimer" from her site [2] contains the following information:
Copyright
All of the material featured on this site is subject to copyright and patented protection unless otherwise indicated. This material may be reproduced accurately and not in a misleading context with prior permission from Mandy Haberman Associates by request to info@mandyhaberman.com. Where the material is being published or issued to others, the source of the material must be identified and the copyright status acknowledged. (emphasis added)
Accordingly I think the image is not in the public domain, rather the copyright status should be acknowledged. The tag {{PD}} is not appropriate in this context. Additionally, we cannot take your word for granted. I would suggest you post a copy of the email indicating "prior permission from Mandy Haberman Associates" as required. We need to be careful about copyright. Thanks for your help. --Edcolins 16:23, 8 December 2005 (UTC)
You are right, I misinterpret the permission Mandy Haberman gave me as public domain, another tag is probably more appropriate. I do find those image copyright tags rather confusing sometimes. I agree that copyright is not to be taken lightly. Here is what Mandy Haberman e-mailed me (on 30 august 2005, 15:19):
Dear Frank,
I am happy for you to use a picture of me, plus a short biography for the web site. You can download pictures of me
and my inventions from the 'image bank' on my website www.mandyhaberman.com
With regard to the biography, below is the text that I generally use but I'm not sure that it is appropriate
in this context. If you would like to put together something more suitable from the information on my
website, then I would be happy to approve it for you. You might find that the 'Time Line' might be helpful for this.
Biography Summary:

This was in response to an email from me in which I explain to her what Wikipedia is and about the terms of use for the text and images. I have more correspondence, however that is mainly regarding private matters since I have two children with cleft.
IMHO this is verifyable - an email to info@mandyhaberman.com should get the confirmation required. I also have her direct email address however I am reluctant to post private email addresses on a public website.
She proofread the article to confirm that I only reported facts. Excerpt from email on 31 august 2005):
Hi Frank,
The website entry looks good however there is one error. Please amend as shown in red in the paragraph below.
Thanks, Mandy

Therefore I assume she agrees with the entry of the text and image. I am not sure what copyright tag goes with this image though. Felsir 06:57, 9 December 2005 (UTC)
Thanks for that. I am not quite whether the new template is sufficient, but it is the most appropriate I have found. --Edcolins 10:49, 9 December 2005 (UTC)
Looks okay to me! I changed the copyright for the Image:Habermanfeeder.jpg in the same way. Since it was obtained in the same request. Felsir 14:02, 9 December 2005 (UTC)
Nice one. Thanks. --Edcolins 16:29, 9 December 2005 (UTC)
