The image linked here is claimed to be used under fair use as: 1) it is a historically significant photo of famous individuals 2) it is of much lower resolution than the original (copies made from it will be of very inferior quality) 3) the photo is only being used for informational purposes and 4) it does not limit the copyright owners rights to sell or promote the video or film in any way 5) it is a promotional photos of a person, e.g. headshots or posed shots 6) it is an image freely provided to promote an item, as in a promotional photo in a press packet.
