This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. Fair use is argued in the following articles: Professional sports in Toronto, Toronto Maple Leafs, History of the Toronto Maple Leafs, 1966-67 Toronto Maple Leafs season and 1967 in Canada for the following reasons:
- The image is of a historic event: the last presentation to date of the Stanley Cup to the Maple Leafs.
- The image captures a particular moment in history in ways that words alone cannot convey.
- A replacement free image would not present the same content.
- The image is low quality, such that downstream commercial use of the image to the detriment of the copyright holders is unlikely.
- Use of the image does not interfere with the copyright holders use of and/or profit from the image.
Use of the image in Red Kelly is for the above reasons, with emphasis on the fact that Kelly's pose is as he is accepting the Stanley Cup for the eighth time, so it captures a unique moment in history. The article also provides critical commentary on him and his linemate, Mahovolich, who is posing in the picture with him.
