Regarding your use of Image:9100.jpg in the bondage hoods article. If you look at the licensing, it says "This work is copyrighted and unlicensed. It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images or Wikipedia:Fair use#Audio_clips. However, it is believed that the use of this work in the article "Bondage hood". Which I believe are your words.

Copyrighted images can only be used in very narrow circumstances. The reason you gave "Where no free equivalent is available or could be created that would adequately give the same information" is one of many criteria, and by itself is not sufficient. Also, the copyright says "To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale." Which you have not yet done.

Proper fair use would be if you were criticizing, reviewing or parodying the work of the artist, or of the genre or style of images. If you used it in an article about the photographer, describing hos this work was (in your opinion) better, or worse that another artist, or their previous work, etc, it would be fair use.

Expecting to use it in the Bondage Hoood article merely because you were not able to find a better non-copyrighted image is not sufficient, even if that were true. (I point out that besided that, there is another free use image already in the areticle that illustrates it.)

Pretty much, unless you get the permission form the artist to use his copyrighted work in an unlimited fashion (basically releasing it into the public domain) or you are the photographer and license it under GFDL or CC-2, or obtain it from a photographer who does that, or unless it is legitimate fair use (review, criticism, parody), you can't put the image in the article. This is User:Jaiwills, who has not only been warned repeatedly about this, but has been indefinitely blocked from the project. Given that he's up to this stuff again, I see no reason not to indefinitely block this account as well. — Matt Crypto 18:33, 1 February 2007 (UTC)
