The exact date of the crash of this plane (killing both pilots) is known: July 17, 1933. Hence more than 70 years have passed since the death of the author; the image now should be public domain, like the second world war images from Commons. While the photograph probably lived longer, his work was purely technical: this is not a photographic art.

This picture (part of the film) was taken by the American company, but the material was later sold to the Lithuanian (Europe) TV company LNK. After demonstration, LNK donated the material to the Kaunas Was Museum.

I see no reason, why for the 95 year American law should apply to the European owner (Kaunas Was Museum) just because of the original image source, and American owner ( FOX News Network) has sold the rights. The European law demands 70 years after the author death only. For the peace of mind, I put the fair use now and will change into the true public domain after several years (now is 2005).
