[edit] Summary
Lina Medina, at five and a half years of age, seven and a half months into pregnancy. Lina is the world's youngest mother in recorded medical history.
[edit] Source
The image was taken by Edmundo Escomel, a physician-researcher, for his report on Lina which was released in 1939. La Presse Medicale. "La Plus Jeune Mère du Monde." 47(43): 875, 1939 (31 May 1939).
[edit] Fair use for Lina Medina
While the picture is assumed to be subject to copyright I (Toyalla) feel it is covered by the U.S. fair use laws because:
- no free alternative exists;
- Lina Medina, being the worlds youngest mother, is not only a world record but a notable event in medical history;
- the image shows Lina when she was pregnant, a situation that is extremely rare for a girl that is five years old;
- the appearance of a five year old that is pregnant is very unique and might be unimaginable to the average reader;
- it is very unlikely that a similar medical event will be repeated, and even if so, that a free image could be taken in such an event;
- the image is unlikely to be sold for profit, as it's only been used for medical research.
[edit] Licensing
This image is a faithful digitalization of a unique historic image, and the copyright for it is most likely held by the person who took the image or the agency employing the person. It is believed that the use of this Image
qualifies as fair use under United States copyright law. Other use of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use for more information. If this does not accurately describe this image, please remove this tag and provide a different fair use rationale. |
[edit] Note
This image is being used to replace the one used in the article Lina Medina that was provided by Ned Scott. This is because this image is closer to the original as it does not have Medina's eyes blacked out. As subsequent photos that clearly show the subject's entire face are freely available online, and as this event is decades old, I do not believe it is necessary to black out her eyes.
