Somalia lacks an operating government, and therefore the laws of the previous government of Somalia are no longer enforced.

In the previous penal code; Article 409 prohibited homosexual acts. Punishment can be up to 3 years imprisonment.[1]

According to article 410, a security measure may be added to a sentence for homosexual acts, to prevent re-occurrence.[2]
