It is believed that the use of the image Laika.jpg in the article Laika qualifies as fair use because:
- No free alternative exists or could be created.
- It is use purely to illustrate the subject discussed.
- It is of a promotional nature.
- Its copyright status is unknown - it may be public domain.
- It is of much lower resolution than the original (copies made from it will be of very inferior quality).
- It does not limit the rights of the copyright owner (if one exists) to market or sell the work in any way.
- This image is used on various websites without accreditation, so its use on Wikipedia does not make it significantly more accessible or visible than it already is.
- The image is being used in an informative way and should not detract from the original work.
- The image should be allowed to be used in the education of students when discussing the Space Race.
If it is copyrighted it is likely to be by the Soviet (now Russian) Space Program via TASS.
