Replaceable fair use Image:Pol.jpg
Thanks for uploading Image:Pol.jpg. I noticed the description page specifies that the media is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed media could reasonably be found or created that provides substantially the same information. If you believe this media is not replaceable, please:
- Go to the media description page and edit it to add {{di-replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
- On the image discussion page, write the reason why this image is not replaceable at all.
Alternatively, you can also choose to replace the fair use media by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by taking a picture of it yourself.
If you have uploaded other fair use media, consider checking that you have specified how these images fully satisfy our fair use criteria. You can find a list of description pages you have edited by clicking on this link. Sakay.jpg
Hi. I see that you are the uploader of the image at Image:Sakay.jpg, which is said to be in the public domain because its copyright protection has expired. However, in my layman's understanding (or, possibly, misunderstanding), this isn't precisely the case. This image seems to be a cropped and edited portion of this other image. That other image probably is a scanned copy of a photographic image which is in the PD for the stated reason. However, the person who cropped and otherwise edited that other image produced a new work (or a derivative work?), and his authorship rights to that work are protected by copyright. Presuming that you are the author of that cropped and edited image, it seems to me that it is needful for you to edit the Image:Sakay.jpg page, explaining that this image is a cropped and edited version of that other image, that the other image is in the public domain because its copyright protection has expired, and releasing your cropped and edited image into the public domain. - Hello Bill. Unfortunately, I am not the author of that "derivative" work, and I may have been unaware of the existence of that other image. Probably the better thing to do would be to take that other image and apply the {{PD-Philippines}} tag to it. What is your opinion? - I'm only inferring that the other image is a faithful copy of a PD-Philippines image, but I'd be pretty comfortable cloning a copy of that image and applying that tag to it. I think the current image is better but, as I said above, it seems to me that it may have copyright problems. That current image is hagher quality than the other one — either it was cropped from a higher-quality image than the other one we're discussing, or it was edited by someone with photoshop skills much better than mine. I tried to crop and edit the other image myself, and wasn't happy with the results. Given that, I think the best option currently available is to upload a copy of the other image, put a PD-Philippines tag on it, and replace the current image with that one.

The image which went with that page had the same name as the current one, but contained the image we've been discussing with a red circle photoshopped in around Sakay's head. If you could provide more media for the article, such as an image of Juan Araneta, that would be great. If the photo is more than 50 years old, that would fall under public domain in the Philippines, and may be uploaded into Wikipedia. I had taken the liberty of fixing up the articles on the other Aranetas too: Gregorio S. Araneta, Salvador Araneta, Stella Araneta and even Gemma Cruz Araneta, just getting those articles to conform to Wikipedia conventions. If you did not create this file yourself, then you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, then their copyright should also be acknowledged.
As well as adding the source, please add a proper copyright licensing tag if the file doesn't have one already. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Fair use, use a tag such as {{non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. If you believe this media is not replaceable, please:
- Go to the media description page and edit it to add {{di-replaceable fair use disputed}}, without deleting the original replaceable fair use template.
- On the image discussion page, write the reason why this image is not replaceable at all.
Alternatively, you can also choose to replace this non-free media by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by taking a picture of it yourself.
If you have uploaded other non-free media, consider checking that you have specified how these images fully satisfy our non-free content criteria. Some items, especially the single words may need to be tweaked a bit later, since I'm not sure if these will be used in the context of a noun or a verb (there are subtle differences between them).
