[edit] Summary
[edit] Fair use for Kukla, Fran and Ollie
Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:
It is a television screenshot made by a user in the early 1950s, and comes from my personal collection. It is a historically significant photo of characters on a well-known television program. It is quite small and of much lower resolution than the original. Copies made from it will be of very inferior quality. The photo is only being used for informational purposes - it would be very difficult for readers to understand the program in question without seeing some image of the three main characters. Its inclusion in the article adds significantly to the article because the photo and its historical significance are the object of discussion in the article.
It also falls under Wikipedia's fair use policy:
Film and television screen shots: For critical commentary and discussion of the cinema and television.
[edit] Licensing
This image is a screenshot of a copyrighted television program or station ID. As such, the copyright for it is most likely owned by the company or corporation that produced it. It is believed that the use of a limited number of web-resolution screenshots
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, might be copyright infringement. For more information, see Wikipedia:Non-free content. |
