Rationale: The photo is used to show the Bofors 155mm Howitzer - an essential tool in the Kargil War - and uses only a B&W image and does not come from a commercial source. So there is no question of loss of revenue. Though the images are not in public domain the Indian Information Act states that they can be used to dissipate information. Therefore this image is in fair use.
