In arguendo if somehow this is discredited then the fairuse reasoning can be 1. The use is for non-commercial, educational purposes. 2. The picture shows an attempt to assassinate German dictator Adolf Hitler. These are the only images that I have discovered of these works. 3. I believe that these images in the original have no commercial value that will be impacted.
