The original of this scanned photograph of Joseph Jenkins (Trecefel, Ceredigion) was taken before the subject's death in 1898 and the image was published by Daniel Jenkins in Cerddi Cerngoch (Caxton, Lampeter 1904). No authorship is signified for this photograph though others in the same book have authors ascribed to them. The photograph is in the public domain because: 1. The work was created and first published [in 1904] before January 1, 1923, or at least 95 years before January 1 of the current year, whichever is later; 3. [To the best of my knowledge,] No Berne Convention signatory has passed a perpetual copyright on the work; and 4. [To the best of my knowledge,] Neither the United States nor the European Union has passed a copyright term extension since these conditions were last updated. Portion of this same image has been reproduced as the front softcover illustration of the book Pity the Swagman by Bethan Phillips (publ. Cymdeithas Lefrau Ceredigion Ltd, 2002) which acknowledges Miss Frances Evans of Tregaron (an elderly great-granddaughter of the subject) as the source of an original photographer's print used for that purpose. I am a historian of the Jenkins family of which I am a member, and am related and known as such to the same Miss Frances Evans. The present scan was made by myself, Brian Jenkins, from my own copy of Cerddi Cerngoch.
This image is in the public domain in the United States because it was first published outside the United States prior to January 1, 1923. Other jurisdictions have other rules, and this image might not be in the public domain outside the United States and should not be transferred to Wikimedia Commons unless it can be verified to be in the public domain in its country of first publication. Also note that this image may not be in the public domain in the 9th Circuit if it was published after July 1, 1909. |
Notice to uploaders: To use this template, the image must meet both of the following two conditions: (1) published over 70 years ago, and (2) the original author's actual identity was not publicly disclosed in connection with this image within 70 years following its publication. Images that lack either of these two conditions should not use this template. Reasonable evidence must be presented that the author's name (e.g., the original photographer, portrait painter) was not published with a claim of copyright in conjunction with the image within 70 years of its original publication. |
