[edit] Fair use rationale for Joseph Byrne
This image, (cropped from [1]) is being linked here; though the picture is copyright © to holby.tv, I feel it is covered by the U.S. fair use law because:
- The image is a low-resolution copy of a publicity photograph;
- The image is being used for informational purposes about Joseph Byrne, a main character from the television programme Holby City;
- No more free alternative exists;
- The use of the image in these articles will have no effect on the BBC's commercial use of the image in question.
This work is copyrighted and unlicensed. It does not fall into one of the blanket acceptable non-free content categories listed at Wikipedia:Non-free content#Images or Wikipedia:Non-free content#Audio clips. However, it is believed that the use of this work in the article "Joseph Byrne" :
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content and Wikipedia:Copyrights. |
