The usage terms for mugshots on the Wikipedia keep changing - they're either allowed for illustration, or need fair use justification. For what its worth, most police departments apparently release mug shots into the public domain. But in any case, this meets fair use as an iconic, irreplaceable photograph of Jennifer Capriati, discussed as such in our article, and multiple news media, such as
