1. No free alternative can exist given the likeness of the character Superman is a trademark and thus protected;
2. It is a low resolution copy of an individual panel from a comic book story;
3. It does not limit the copyright owner's rights to sell the comic book storyline in any way;
4. Copies could not be used to make illegal copies of the comic book storyline in another comic book;
5. The image is significant; it depicts the return to continuity of the golden age Superman;
6. The storyline in question is discussed within the article, thus using this image to identify the issue is thought fair use;
