This photograph is a derivative work of art based on a miniature created and copyrighted by Games Workshop. As such, it is used on Wikipedia under Fair Use guidelines only.

The author of the image (Pacifier) has allowed the photograph itself to be reused under the terms of the GFDL – However, as a derivative work this will only take effect from the moment Games Workshop's copyright on the miniature design expires (barring their explicit permission to reuse the image under a free licence). As stated above, until that time the photograph may only be used under Fair Use guidelines.

This image, ImperialGuard.jpg, is being linked here; though the picture is subject to copyright I (Pak21) feel it is covered by the U.S. fair use laws because:

  1. No equivalent free image can be created
  2. It adds significantly to the article by displaying characteristic miniatures of the race being discussed
  3. The use of this image on Wikipedia will have no impact on the commercial value of the image, the product displayed within the image, or any other works the image is currently used in.
