Though the picture is subject to copyright I feel it is covered by the U.S. fair use laws because:

• it is a low resolution still of a television episode;
• it does not limit the copyright owners rights to sell the episode in any way;
• it illustrates the episode in question and aids commentary on the plot outline.
• this image was chosen because Mr. Bennet faces Sylar face-to-face without any protection and realizes that Sylar is not dead but free.
• The copyright is most likely held by the studio that produced it, NBC
