[edit] Rationale of fair use for Mariah Carey
The image Image:IBT.jpg is being linked here; though the picture is originally copyright, I (Extraordinary Machine 01:47, 19 November 2005 (UTC)) feel it is covered by fair use because:
- The image is a screenshot from a promotional music video intended by Columbia Records for wide distribution.
- No free or public domain images have been located for the episode of this television show or this single. While a public domain image has been located for the subject of the article, it does not adequately illustrate major points in the subject's career that are discussed in the article.
- The screenshot does not limit the copyright owners' rights to distribute the television show, single or music video in any way.
- The screenshot is intended to represent the subject in her first widely-seen concert performance. Its inclusion in the article is important because it represents a significant point in the subject's career that is discussed in the article. The subject is well-known for her distinctive vocal style and extensive vocal range, and her appearance on the show proved that her vocal abilities were not, as some believed, simulated using studio techniques. Additionally, it should be noted that the image depicts the subject performing the song live in front of an audience. In other words, this image is a suitable image to accompany discussions related to a recording artist often highly regarded for her vocals.
- The screenshot is being used for informational purposes only, and its use is not believed to detract from the original television show, single or music video in any way.
