- The image was published as a wire service news photograph in the U.S. in 1947. Per the Library of Congress, there is no evidence that copyright notice was originally filed on the image, as then required.
- A search of copyright renewal records for 1974 and 1975 ([1], [2], [3], [4]) reveals no evidence that the Associated Press renewed copyright to this photograph or any collection of photographs or any collection of material that might encompass this photograph as would have been required to maintain copyright protection, if any.
- There is no evidence that the Associated Press claims copyright on the image.

If any evidence is disclosed to indicate that this historical photograph is under copyright, the image linked here is claimed by Wikipedia editor DCGeist to be used under fair use as:
- it is a widely disseminated news photograph of an event of major historical significance (see, e.g., [5]);
- it is of much lower resolution than the original (copies made from it will be of very inferior quality);
- its use does not impair the original rights holder's right to sell or promote the image in any way;
- it is being used only for informational purposes; and
- its inclusion in Hollywood blacklist adds significantly to the article because it illustrates the HUAC hearings central to the initiation of the blacklist and the degree of new coverage they received at the time.
