This image is listed under fair use, as it is purely illustration for an article on the game. The image itself, as part of the article, is increasing awareness for the game, and as such the copyright holder will have no problems with it, considering it's actually almost promotional, as a sales device. Also, the image is clearly a photograph, not a scan, and is too low of quality to be of any threat of creating counterfeits.
