[edit] Fair use in Janey_Godley

Though the design of the cover of the book shown is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

  1. It is the paperback cover of Janey Godley's autobiography - her first published work - and, although the Wikipedia article is not wholly about the book itself, it is about her life, which is also the subject of the book. The image of the paperback cover is placed at the point in the article which refers to the publication of the paperback autobiography - which the subject of the article wrote.
  2. It is a low resolution image, and thus not suitable for the production of counterfeit goods.
  3. The small, low-res image of the book cover is not used in such a way that a Wikipedia reader would be confused into believing that the article is written or authorized by the publisher of the book nor that the Wikipedia article could in any way be any extract from the book.
  4. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value in that the purpose of the usage is to show an image of the book written by the subject of the Wikipedia article and mentioned in the article at that point. So there is no comparable image available. It also demonstrates visually the market at which the publisher aimed the book; and it is interesting to compare the original hardback design with the 'softer' paperback design.
