Though the design of the cover of the book shown is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:
- It is the hardback cover of Janey Godley's autobiography - her first published work - and, although the Wikipedia article is not wholly about the book itself, it is about her life, which is also the subject of the book. The image of the hardback cover is placed at the point in the article which refers to the publication of the hardback autobiography - which the subject of the article wrote. The only image on the cover (other than text) is a single photograph the copyright of which is owned by Janey Godley, who has no objection to it being used within the context of a small JPEG to illustrate a Wikipedia article referring to the book. The publisher does not own copyright of the photograph used on the book jacket.
- It is a low resolution image, and thus not suitable for the production of counterfeit goods.
- The small, low-res image of the book cover is not used in such a way that a Wikipedia reader would be confused into believing that the article is written or authorized by the publisher of the book nor that the Wikipedia article could in any way be any extract from the book.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value in that the purpose of the usage is to show an image of the book written by the subject of the Wikipedia article and mentioned in the article at that point. I could freely use the photograph used by the publishers on their cover, but this would not fairly illustrate the published book nor would it have any relation to the adjacent Wikipedia text, which is referring to the book. So there is no comparable image available.

This image is of a book cover, and the copyright for it is most likely owned either by the artist who created the cover or the publisher of the book. It is believed that the use of low-resolution images of book covers
qualifies as fair use under United States copyright law. Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content for more information. |
