The author asserts the image qualifies for fair use for the following reasons:

1. The image is intended to illustrate and identify one or more established characters in the game.
2. There is no intention to reveal any further details of the game aside the presence of the character itself through this image.
3. The image's resolution is deemed sufficiently reduced, if not already reduced when the image was originally uploaded. The maximum size of such images is 600x480 pixels wide; and is only to be used if the number of depicted characters demands it.
4. There are no free alternatives to this image as the screenshot is derivative of a copyrighted video game.
