I believe this image to be fair use for the following reasons.
- Gordon Park is currently in prison, and so providing a free alternative would be impossible.
- The image is available freely from the freegordon website, which was set up by his son, the copyright holder of the image, to raise awareness.
- Using this image will aid in raising awareness, therefore aiding the purpose for which the image was originally uploaded to the Internet.
- Using this image will add significantly to the Lady in the Lake trial article.
- Image is no larger than it needs to be.
- The image has minimal commercial value.
This work is copyrighted and unlicensed.
