I believe this image to be fair use for the following reasons.

Gordon Park is currently in prison, and so providing a free alternative would be impossible.
The image is available freely from the freegordon website, which was set up by his son, the copyright holder of the image, to raise awareness.
Using this image will aid in raising awareness, therefore aiding the purpose for which the image was originally uploaded to the Internet.
Using this image will add significantly to the Lady in the Lake trial article.
Image is no larger than it needs to be.
The image has minimal commercial value.
