I believe that use of this image in the Wikipedia article Getting Out of Nowhere qualifies as fair use under United States copyright law for the following reasons:

  • The image is irreplaceable; a free analogue is impossible to produce
  • Only a small portion of a copyrighted work is used
  • The image is used solely to illustrate the audio recording in question
  • The use of this image does not compete with the copyright holders' usage
  • The image is of inferior quality compared to that of an original, having been reduced to a web-resolution
