[edit] Capture and detention
Bin Attash, and his teenage brother, Hassan bin Attash, were captured in an alleged al Qaida safe house, in Karachi.
The Americans held the bin Attash brothers in a network of clandestine interrogation sites, colloquially known as the black sites. The brothers were reported to have been held, for a time, in the dark prison. Walid's younger brother Hassan was transferred to military custody, in the Guantanamo Bay detention camps, in Cuba.
Walid bin Attash was transferred to military custody in Guantanamo, together with 12 other high-value detainess. They were the first captives to be transferred to Guantanamo in two years. Unusually President Bush personally announced there transfer, while the identity of other transferred captives had been kept confidential.
President Bush announced that the 14 men would face charges before military commissions. Although the United States Supreme Court has yet to finish ruling on all the legal issues arising from the nature of the detention of of the Guantanamo captives.
Prior to facing charges before a militaty commission the 14 men's status was to be determined by a Combatant Status Review Tribunal.
