[edit] Appointment of Mayors following the 2006 municipal elections
Following the 2006 municipal elections, the mayors of four municipalities with linguistic facilities in the Flemish Periphery around Brussels, Kraainem, Linkebeek, Sint-Genesius-Rode and Wezembeek-Oppem, were not appointed by the Flemish Interior Minister Marino Keulen (SP.A) because their municipalities had sent letters of convocation (letters calling citizens to vote and informing them where their polling station is) in French. This constituted a breach of rules established by the Flemish Government, including the Peeters Circular, which stipulate that the municipal authorities in municipalities with linguistic facilities must send all documents to all citizens in Dutch, after which citizens who wish to obtain a copy of the document in French must personally and for each individual document request to be furnished with a French translation of the document. Prior to the controversial Peeters Circular, citizens who had indicated their desire to communicate with the municipal authorities in French automatically received all subsequent documents sent to them by the municipal authorities in French. The Peeters Circular was sent to the provincial governors by then Flemish Interior Minister Leo Peeters (SP). It was later augmented with the Martens Circular and reaffirmed by the Keulen Circular.
The four mayors are Arnold d’Oreye de Lantremange (Kraainem), Damien Thiéry (Linkebeek), Myriam Delacroix-Rolin (Sint-Genesius-Rode) and François van Hoobrouck d’Aspre (Wezembeek-Oppem). Apart from Myriam Delacroix-Rolin, who is a member of the Humanist Democratic Centre (French: Centre démocrate humaniste or CDH, the French-speaking Christian democratic party), the mayors who were not appointed are members of the Democratic Front of Francophones (French: Front Démocratique des Francophones or FDF). The four had been presented for appointment as mayor by their respective municipal councils.
In Kraainem, Linkebeek and Wezembeek-Oppem, the municipal authorities again sent letters of convocation in French for the 2007 federal election. The municipal authorities of Sint-Genesius-Rode complied with the rules of the Flemish Government this time and only sent letters of convocation in Dutch to all citizens for the 2007 federal election.
Flemish Interior Minister Marino Keulen (SP.A) announced on November 14 that he had decided to follow the advice of the Governor of Flemish Brabant, Lodewijk De Witte, and not appoint the mayors of Kraainem, Linkebeek and Wezembeek-Oppem. He sent a letter to the municipal councils of Kraainem, Linkebeek and Wezembeek-Oppem, asking them to present a new candidate for appointment as mayor. However, as long as no other mayors have been appointed, the three can remain in office as acting mayors.
Minister Marino Keulen decided to appoint the fourth mayor, Myriam Delacroix-Rolin (CDH), the Mayor of Sint-Genesius-Rode; her municipality had only sent letters of convocation in French once, for the 2006 municipal elections.

Following the election, the following government coalitions are possible:
- Orange-blue, a coalition consisting of christian democrats (CD&V/N-VA, CDH) and liberals (Open Vld, MR). This coalition would have 81 seats out of 150 in the Chamber of Representatives, not the two-thirds majority required to amend the Constitution. This is the most likely coalition and the one Yves Leterme pursued as formateur, however, it will need the support of the socialists in order to accomplish a state reform.
- A classical tripartite of christian democrats, liberals and socialists (SP.A, PS). This coalition would have 115 seats out of 150 in the Chamber of Representatives, enough to amend the Constitution. It was rejected by
- A so-called Jamaican coalition consisting of christian democrats, liberals and greens (Groen!, Ecolo). This coalition would have 93 seats out of 150 in the Chamber of Representatives and was proposed by Louis Michel and would isolate the PS. This coalition would be able to amend the Constitution with the support of the SP.A.
- A so-called olive tree coalition consisting of christian democrats, socialists and greens. This coalition would have 86 seats out of 150 in the Chamber of Representatives.
- Purple-green, a coalition of liberals, socialists and greens. It would have 87 seats out of 150 in the Chamber of Representatives, however, it would not have a majority in Flanders with only 36 out of the 88 Flemish Representatives in the Chamber. This coalition was rejected by the socialist parties, who opted for the opposition.
- An asymmetrical coalition of CD&V/N-VA and Open Vld on the Flemish side, and MR and the PS on the Francophone side. This coalition would have a majority of 91 seats out of 150 in the Chamber of Representatives and the support of the SP.A would suffice for amending the Constitution. It is called an asymmetrical coalition because the Flemish socialists and the French-speaking christian democrats would be in the opposition whereas the French-speaking socialists and the Flemish christian democrats would be in government at the federal level.

On June 13, 2007, King Albert II appointed MR leader Didier Reynders informateur. His job was be to assess the possibilities for government coalitions. Prior to his appointment, in his position as party leader, Reynders had indicated his preference for a coalition of Christian Democratic parties CD&V (Flanders) and cdH (Wallonia) and liberal parties MR (Wallonia) and Open VLD (Flanders). Reynders presented his final report to the King on July 4, 2007.

On Tuesday August 14, the French-speaking parties at Valley of the Duchess were presented with a list of Flemish demands. Although they officially decided to refrain from commenting on the list, the leader of CDH, Joëlle Milquet, told the press that some demands were not acceptable. Didier Reynders, the leader of MR, took a softer stand and left a window for discussion. He said that some demands were negotiable while others were less so. The French-speaking parties had requested formateur Yves Leterme to compile a list of Flemish demands in order to continue the negotiations on the communautary issues.
The Francophone parties at the negotiating table, MR and CDH, presented their answer to the list of Flemish demands on Thursday August 26. They also had a list of counterdemands, these demands included, among others, equal representation in the Senate, removing some of the guarantees for Flemings in Brussels, such as the guaranteed representation in the Brussels Parliament, altering the language border, expanding the Brussels-Capital Region and a referendum on the future of the Flemish municipalities around Brussels. These demands were seen by the Flemish negotiators as a provocation. Bart Somers, the leader of Open Vld said that the Francophone demands "can't be taken seriously" and that the demands would undermine the balances of Belgium.
Christian Van Eycken of the Union of Francophones stated to the VRT that the "composition of the Brussels Parliament is not proportional to the population of Brussels". Kris Van Dijck of the N-VA responded by pointing out that the composition of the Federal Government is also paritary (meaning that it is composed of an equal number of Flemings and Francophones, with the exception of the Prime Minister), although the Flemings constitute a majority in Belgium.
Due to differences in view with regards to constitutional reform between the Flemish and Francophone parties, the cabinet negotiations proceeded with much difficulty and were temporarily halted on August 17 to give the King the possibility to mediate.

On Tuestday August 21, the French-speaking parties MR, CDH, PS and Ecolo met in Brussels in order to discuss the communautary issues that have arisen during the negotiations between CD&V, VLD, MR and CDH.
On the evening of Wednesday August 22, the negotiators of the Orange-Blue parties met in the office of the President of the Belgian Chamber of Representatives, Herman Van Rompuy, where they reportedly tried to convince Joëlle Milquet of the CDH...

Originally, a final meeting with the Orange-Blue party presidents was planned in the afternoon but it was cancelled at the very last minute. Following Leterme's resignation it will be up to the King to decide what happens next. It is likely that a new Informateur or a new mediator, probably a French-speaking Christian-Democrat of the CDH, will be appointed. Philippe Maystadt and Melchior Wathelet have been mentioned as possible informateurs.
During a meeting of the parliamentary fractions of CD&V and N-VA, a majority of those present voted to halt the coalition talks. The Flemish cartel doesn't see a way out of the stalemate surrounding the issue of state reform as long as the CDH is at the negotiating table.

The resolution of 3 March 1999 regarding the general principles and objectives of Flanders with regard to next state reform. (Dutch: betreffende de algemene uitgangspunten en doelstellingen van Vlaanderen inzake de volgende staatshervorming)
The resolution requests the application of Article 35 of the Constitution by transferring the so-called residuary competences to the constituent states. This would mean that the powers not expressly delegated to the federation by the Constitution, are reserved to the constituent states. Article 35 has never entered into force because the exclusive powers of the federal State have not been defined and because a law needs to be adopted specifying which of the remaining powers are reserved to the Communities and which are reserved to the Regions.

- 1. The principle of territoriality and the principle of non-interference must be fully realised and guaranteed.
- 2. Flanders must also become responsible for the organisation of the administrative supervision in the peripheral municipalities and Voeren, as well as for the regulation of the use of languages in the municipalities with a special linguistic statute.
- 3. The constituent states must be involved in the presentations of members of the highest control organs: the Court of Arbitration, the Council of State and the Court of Audit.
- 4. The constituent states must determine the rules on the management and the control of their finances themselves. The federal Court of Audit, composed of a Dutch-speaking and a French-speaking Chamber, is dependent upon both the Chamber of Representatives and the parliaments of the constituent states.

On the agenda for the plenary session was the topical interpellation by Filip Dewinter (Vlaams Belang) of Kris Peeters (CD&V), the Minister-President of the Flemish Government and Flemish Minister of Institutional Reform, Ports, Agriculture, Sea Fisheries and Rural Policy, on the stance of the Flemish Government on the impasse in the communautary negotiations at the federal level.

Following the topical interpellation, three reasoned motions were introduced by members of List Dedecker, Vlaams Belang and Green!. The motions of Vlaams Belang and Green! were introduced and referred to the plenary assembly by the Speaker on 10 September, the day of the interpellation, that of List Dedecker on 12 September. The Parliament will consider these motions its next plenary session.
Jurgen Verstrepen, an independent member of the Flemish Parliament for List Dedecker introduced a motion asking the Flemish Government to reaffirm its formal commitment, contained in the Flemish government agreement of 2004. to realise the five resolutions of the Flemish Parliament of 3 March 1999 and to urge the Flemish negotiators in the 2007 Belgian government formation to include the Flemish resolutions in the federal government agreement. The motion also asks the Flemish Government to, together with the Flemish Parliament, evaluate the federal government agreement and, if necessary, look into which measures can be taken to obtain the full realisation of the Flemish resolutions.

Mieke Vogels, Jef Tavernier, Eloi Glorieux and Rudi Daems of Green! introduced a motion subscribing to the principle of federal solidarity, asking the swift splitting of the electoral arrondissement of Brussels-Halle-Vilvoorde, and asking the Flemish Government to take the initiative, together with the governments of the other constituent parts of Belgium, to create a broad forum of politicians, scientists and representatives of civil society, for the purpose of drafting a transparant and simplified model for modern federal Belgium before 1 January 2009.
