In Brazil, the Constitution requires that intentional crimes against life, whether attempted or committed, be judged by juries; no other offenses are tried before them. The Brazilian Penal Code defines four such crimes: murder, infanticide (which is codified separately), inducing or assisting suicide, and abortion (with exceptions for rape and danger to the mother's health). The prosecution and the defense are each entitled to three peremptory challenges. Jurors are explicitly defined as finders of fact. Their role is limited to deciding whether the offense has actually occurred, if so, whether it was indeed committed by the accused, and whether any aggravating or mitigating circumstances apply.

Jurors decide whether the defendant is guilty or not by answering "yes" or "no" to a series of predefined questions (quesitos). Jurors vote in the presence of the judge, the prosecution and defense, the court reporter, and two court officers. Unanimous verdicts are not required—a simple majority suffices.
