[edit] Fair use

This image is not replaceable as Rachel Stewart no longer performs live with Fluke and, to the best of my knowledge, no free alternative exists or is ever likely to exist. Furthermore I obtained permission from the copyright holder to use this image on Wikipedia, the transcript of which can be seen on the image rationale page. Martin Hinks 07:32, 30 August 2007 (UTC)

I have now provided a far more detailed rationale for this image which I believe satisfies all the criteria of WP:NFCC. If I have inadvertently missed anything it would be greatly appreciated if I were given a chance to attempt to fix the rationale *before* the image is deleted (I appreciate that if the rationale cannot be made to work then the image has to go, I just believe that this is a genuine case of fair use). The usage on the article about her as a person is certainly replaceable; nonfree photos of living people used to identify them are considered replaceable as a general principle. On the article about the band, the image is used not to illustrate Stewart (she is pictured at the top of the article in a free nonfree image), but to illustrate their live performances. The article says these performanced have decreased; is the band performing any more at all? — Carl (CBM · talk) 12:53, 30 August 2007 (UTC)
The band have not done a live show for many years now (last one I know of was around 2000) and there are currently no planned shows, so it looks pretty much irreplaceable to me. I agree about the usage in the Rachel Stewart article being inappropriate and have removed the rationale for that article, but I really don't think I am going to be able to find a completely free image of the band's live performances and, as the article is short on images anyway (resorting to album covers) and this is a previous (and will be future) featured article candidate, it would greatly suffer without an image of them performing. Thanks for the discussion, I hope we can resolve this, especially so as I managed to get permission from the copyright holder. Martin Hinks 15:07, 30 August 2007 (UTC)
Thanks for clarifying that. I removed the deletion tags; if the band isn't performing then we can't expect someone to take a photo of the performance. The issue with permission is that if the permission is just "OK, use the image" then the image is still considered nonfree because there is no permission for others to use and change the image. — Carl (CBM · talk) 15:27, 30 August 2007 (UTC)
Great, I appreciate the problem with redistribution of the image, but, as said, it's currently impossible to obtain a free image of the band. If the band were to tour again (and this seems increasingly unlikely), we can hopefully replace this with a free image. Many thanks for helping to resolve this.
